Employer Labour Disputes in Tanzania: 14 Workplace Challenges HumanValue Helps Employers Address

Published November 7, 2026 81 Views

Before you issue a termination letter, check whether your file tells the same story as your managers. What did the employee know? What can you prove? What did the employee say when given a chance to respond? Those questions can change how you handle a disciplinary matter and how you prepare if it reaches the Commission for Mediation and Arbitration (CMA).

I’m Emily Sebashahu, a CMA registered representative. At HumanValue Consulting, I work with advisers who specialise in labour relations, workplace discipline and CMA matters in Mainland Tanzania. We help employers review the facts, choose a fair procedure and prepare the records they will need. If you already have a CMA notice, tell us the hearing date or deadline when you make contact.

14 workplace challenges we help employers handle

These are the kinds of matters our team has handled on the employer side. HumanValue has reported favourable outcomes in these categories. We discuss the issues here in general terms and keep client names, employee details and case files private. Each matter turns on its own facts and records.

Probation and suitability for the role

Start with the expectations you communicated, the feedback you gave and the employee’s response. We review the assessment and the contract with you, including what the employee was told about any proposed extension or decision.

Insubordination

Write down the instruction, who gave it and when. Check whether it was clear, lawful and reasonable, and hear the employee’s explanation. We help you separate a refusal from a misunderstanding or a genuine safety concern.

End of a fixed-term contract

Put the contract, renewal letters and any promises about continued work in date order. We check the expiry terms and the employer’s communications so you can assess any claim that the employee expected renewal.

Constructive termination

If an employee says they resigned because working conditions became intolerable, read the complaints and the employer’s responses alongside the resignation. We help reconstruct what happened and identify the documents and witnesses that can speak to each event.

Suspected fraud

Secure the relevant records and control access to them. Record who collected each document and where it came from. We help define the investigation and frame the allegation from the evidence available at that stage.

Abscondment

If someone stops coming to work, check the roster, contact attempts and any information about the absence. We review the timeline and the steps available before you make a decision about the employment relationship.

Prolonged illness and extended sick leave

Keep health information restricted. Review the leave record, the employee’s capacity to do the work and any reasonable changes you can consider. We help you assess the appropriate procedure and what information is needed for that review.

Retrenchment and restructuring

Explain what has changed in the business and which roles are affected. We help organise the business reasons, alternatives, consultation records and selection criteria so you can account for how the proposal was reached.

Breach of an employment contract

Identify the term at issue and how it was applied. Bring the signed agreement, any amendments and the correspondence. We help you compare the written obligation with the conduct or decision being challenged.

Gratuity and terminal benefit disputes

Reconcile the amount claimed against the contract, policy, applicable law and payment records. We help you separate each item so the calculation and its basis can be explained clearly.

Poor performance

Show the expected standard, how it was communicated and the support the employee received. We review targets, feedback and opportunities to improve. A performance file should let someone outside your business see what changed over time.

Gross dishonesty

Identify the statement or act you say was dishonest and check it against the original records. We help you organise the evidence and the employee’s explanation before considering a proportionate response.

Unauthorised taking of employer property

Confirm what property is involved, who had access and what records show it was removed. We help the employer document the allegation, hear the response and consider the appropriate internal and external steps.

Repeated absenteeism

Review attendance against the actual roster, approved leave, messages and earlier warnings. We help you check whether the pattern is supported and whether comparable cases were treated consistently.

How employers can enquire for free

HUMANVALUE | EMPLOYER CMA SUPPORT

Send a free employer enquiry

2. Book an employer consultation
Choose Employer on the booking page. The initial consultation costs TZS 50,000. A consultant contacts you within 24 hours of verified payment. Representation and further work are scoped and agreed separately.

What happens when you bring a matter to us

We start with a short timeline. Tell us what has already happened, what management proposes to do and whether anyone has received a formal notice. We look at the contract, policy and evidence alongside the applicable procedure. If there is a gap, we tell you what it is and what can still be done.

For a pending hearing, we can help you organise the documents, identify who can speak to each fact and prepare for the issues the other side may raise. If you want representation, we first check the scope, eligibility and terms for your matter.

Keep the details private

Use LinkedIn for an introduction and the enquiry form for a short summary. Leave out employee names, medical records, identity documents and witness statements. We will agree on a private channel before you send records. We handle information under our CMA support and booking terms and applicable confidentiality requirements. Disclosure can be required by law or an applicable proceeding.

Five questions to check before a disciplinary decision

  1. Can we describe the concern in plain language and point to a record that supports it?
  2. Have we chosen the procedure that fits the issue, such as misconduct, performance or incapacity?
  3. Did the employee understand the issue and have a fair opportunity to respond?
  4. Can a reviewer follow the dates, the evidence and the reasons for the decision?
  5. Have we checked the contract, applicable law and any urgent deadline?

If one answer is unclear, bring that question to the consultation. If your managers need practice running hearings, our Handle Disciplinary Meetings with Confidence course includes ten lessons and twelve editable workplace tools. Individual access costs TZS 400,000.

Frequently asked questions

What if the CMA hearing is close?

Check the date on the notice and contact the CMA if you need to confirm the procedure. Tell us the date when you enquire. A HumanValue booking does not file a response or extend a deadline.

Can I ask about support before paying?

Yes. Use the free enquiry to check which service fits. Book the paid consultation when you are ready for a review of your own matter.

Which records should I prepare?

Start with a dated timeline, the relevant policy and contract, correspondence, and any hearing or CMA notice. Keep the originals and wait for the private sharing instructions before sending sensitive material.
